Permanent Establishment (PE)
Permanent Establishment is a tax-law concept under which a foreign company's activity in a country becomes sufficient to trigger local corporate tax obligations, even without a registered entity. PE risk is a top reason companies use an EOR for early international hires.
PE is typically triggered by a fixed place of business, dependent agents who can bind the company to contracts, or extended on-the-ground operations. Even a single senior executive working from a foreign country can create PE exposure. The consequences range from filing local corporate tax returns to owing tax on globally allocated profit. An EOR isolates individual employees from creating PE for the client; a country entity is required once operations exceed EOR-appropriate scope.
